Additional statutory leave and public holiday

The law of 25 April 2019 amending: 1. articles L. 232-2 and L. 233-3 of the Labour Code; 2. article 28-1 of the modified law of 16 April 1979 establishing the general status of civil servants, was published in Mémorial A no. 271 of 26 April 2019 (hereinafter referred to as “the Law”). The Law came into force retroactively as of 1 January 2019.

On the one hand, the Law establishes an increase to the minimum statutory paid leave from 25 to 26 days per year and, on the other hand, declares Europe Day, celebrated on 9 May, as a statutory public holiday.

As a reminder, the new provisions cannot “result in an automatic increase to more favourable statutory or contractual provisions applicable on the date on which it comes into force.[1]
