The agreement on inter-professional social dialogue within the context of the training plan of staff delegates in “the first year of their term” signed on 20 October 2020 by the Union des Entreprises Luxembourgeoises (UEL), the OGBL and the LCGB (hereinafter the “Agreement”), was declared a general obligation by the Grand Ducal Regulation of 22 January 2021, published in Mémorial A no. 77 of 29 January 2021.

The Agreement only affects staff delegates elected for the first time in 2019 who, for the first year of their term, benefit from extra hours for training leave, as stipulated by article L.415-9 of the Labour Code.

The Agreement is intended to take into account the impact of the health crisis on the possibility of using these hours of training leave specifically for their 1st office term in 2020, and with this in mind, stipulates the following:

  • the extra 16 hours of training for the 1st term of regular staff delegates can be used up until 31 March 2021 at the latest
  • the extra 8 hours of training for the 1st term of substitute staff delegates can be used up until 31 March 2021 at the latest
  • if done during working hours, participation in training is only possible with the employer’s agreement
  • subject to this agreement, and insofar as it is possible, the training hours specifically for the 1st term should preferably be used during periods of weather-related layoff, short-time working or when the company’s business is slow.

The Agreement comes into effect retrospectively as of 20 October 2020, the date on which it was signed. It will cease to have effect on 31 March 2021, apart from activities relating to the financial accounts.
