  • Resumption of apprenticeship contracts for the2nd half of 2020/2021

The Law of 8 July 2021 introducing a temporary exemption from article L. 111-3, paragraph 4, of the Labour Code was published in Mémorial A no. 519 on 13 July 2021 and came into force on 17 July 2021.

The Law stipulates that during the second half of the 2020/2021 academic year, the resumption of apprenticeship contracts is permitted and authorised without the need to apply the statutory waiting period of 6 weeks, as a temporary exemption from Article L. 111-3 (4) of the Labour Code.

  • Extension of leave for family reasons until 14 September 2021

The Law of 15 July 2021[1] was published in Mémorial A no. 536 and came into force on 16 July 2021.

In particular, the Law stipulates that the extraordinary family leave scheme introduced within the context of the Covid-19 pandemic (see our Newsflash of 6 April 2021), which was due to come to an end on 17 July 2021, has been extended up to and including 14 September 2021.

  • New recovery aid for the period between July and October 2021

The Law of 16 July 2021[2] was published in Mémorial A no. 540 on 16 July 2021 and came into force the same day.

In particular, the Law stipulates the introduction of a new recovery aid scheme for July, August, September and October 2021 for the sole benefit of businesses carrying out at least one of the economic activities listed in the annex of the Law of 24 July 2020.

Companies concerned can benefit from this new recovery aid if they fulfil the conditions listed by the Law, including in particular the condition that, during the month for which the aid is being requested or the months eligible for aid, they have not made more than 25% of their employees redundant or, if they have four employees or fewer, that they have not made more than one employee redundant, for reasons not inherent to the employee.

The application must be submitted in writing for each month for which it is being requested, by 1 December 2021 at the latest. No aid can be granted after 31 December 2021.

The total amount of the new recovery aid is calculated by multiplying the number of full-time employees in the company by:

  • for July and August 2021: €1,250 per working employee and €250 per employee on full short-time working during the month for which the aid is requested;
  • for September and October 2021: €1,000 per working employee and €250 per employee on full short-time working during the month for which the aid is requested.
